Terms of Service

These Terms of Service (“Terms”) govern your use of the Shopify applications developed and operated by EZ Commerce Apps (“we”, “us”, “our”), including EZ AOV Boost (each “the App”, together “the Service”).

1. Acceptance of terms

By installing and using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

2. Description of the Service

Each app's features are described on its App Store listing and its page on this site. For example, EZ AOV Boost helps merchants increase average order value through:

  • Cart minimums — enforced minimum order values with server-side validation
  • Reward tiers — percentage discounts, fixed-amount discounts, free shipping, free gifts, and store credit, with a live storefront progress bar
  • Product recommendations in the cart
  • A/B testing, the Threshold Advisor, and analytics

Rewards are applied automatically via Shopify Functions — no discount codes are required.

3. Eligibility

To use the App, you must:

  • Have an active Shopify store
  • Be authorized to act on behalf of the store
  • Be at least 18 years old or the age of majority in your jurisdiction

4. Account and access

4.1 Installation

You install the App through the Shopify App Store. Installation grants us access to your store data as described in our Privacy Policy.

4.2 Authorization

By installing, you authorize us to:

  • Access your store data via Shopify APIs
  • Create and manage automatic discounts and validations
  • Provide theme app extensions for your storefront
  • Issue store credit to customer accounts when you configure that reward type
  • Store your configuration data

4.3 Security

You are responsible for:

  • Maintaining the security of your Shopify account
  • All activity that occurs through your installation
  • Notifying us of any unauthorized access

5. Pricing and payment

5.1 Subscription fees

Each app's current price and free-trial period are shown on its Shopify App Store listing and its page on this site. For example, EZ AOV Boost:

  • Price: $12.99 USD per 30-day billing cycle
  • Trial: 30-day free trial with full functionality
  • Billing: Handled entirely through Shopify's billing system

5.2 Payment processing

All payments are processed by Shopify. We do not directly collect or store payment information.

5.3 Cancellation

  • Cancel anytime by uninstalling the App from your Shopify admin
  • No refunds for partial billing periods
  • Access continues until the end of the current billing period

5.4 Price changes

We may change pricing with 30 days' notice. Continued use after notice constitutes acceptance of the new pricing.

6. Acceptable use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to access other merchants' data
  • Reverse engineer or copy the App
  • Interfere with the App's functionality
  • Resell or redistribute access to the App

You are responsible for all content you configure in progress bars, messages, and other merchant-facing settings.

7. Intellectual property

The App, including all code, design, and documentation, is the intellectual property of EZ Commerce Apps. You retain ownership of your configuration, branding, and store content. We grant you a limited, non-exclusive, non-transferable license to use the App while subscribed.

8. Disclaimer of warranties

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF RESULTS.

We do not guarantee:

  • Specific increases in sales or average order value
  • Uninterrupted service
  • Error-free operation

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
  • We are not liable for indirect, incidental, special, or consequential damages
  • We are not liable for lost profits or data loss

10. Indemnification

You agree to indemnify and hold harmless EZ Commerce Apps from any claims arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

11. Modifications to the Service

We reserve the right to modify or discontinue features, update the App, and change these Terms. Material changes will be communicated with reasonable notice.

12. Termination

12.1 By you

Uninstall the App at any time from your Shopify admin.

12.2 By us

We may terminate your access if you violate these Terms, engage in fraudulent activity, or fail to pay subscription fees.

12.3 Effect of termination

Upon termination, your access ends. Configuration data is retained for 48 hours (for reinstall convenience) and then deleted in accordance with our Privacy Policy.

13. Governing law

These Terms are governed by the laws of the State of Oregon, USA, without regard to conflict of law principles.

14. Dispute resolution

Any disputes shall be resolved through:

  1. Good-faith negotiation
  2. Mediation
  3. Binding arbitration (if negotiation fails)

15. General provisions

  • Entire agreement. These Terms constitute the entire agreement between you and EZ Commerce Apps regarding the App.
  • Severability. If any provision is unenforceable, the remaining provisions remain in effect.
  • Waiver. Failure to enforce any right does not waive that right.
  • Assignment. We may assign these Terms. You may not assign them without our consent.
